1. The defendant shall be the plaintiff.
(a) deliver the buildings listed in the separate sheet;
B. From 1,395,520 won and July 22, 2017
Reasons
1. Indication of claim;
A. The building listed in the separate sheet (hereinafter “instant building”) is owned by the Plaintiff and C as one-half shares, respectively, and C succeeds to the network C at the ratio of the Plaintiff 1/6 shares, children D, E, and F, respectively, due to the death of C.
B. On February 25, 2017, the Plaintiff entered into a contract under which the Plaintiff leased the instant building to the Defendant (hereinafter “instant lease contract”) with the Defendant during a fixed period from February 27, 2017 to February 26, 2019, and delivered the instant building to the Defendant.
C. From February 27, 2017 to July 21, 2017, the Plaintiff received from the Defendant only KRW 2.6 million under the name of rent, among the rent of KRW 3.6 million ( KRW 7.5 million x KRW 6 million for four months). The Defendant did not pay KRW 2,60,000,000 remaining after deducting the said rent of KRW 2.6 million, and KRW 80,000,000,000,000 and KRW 2,63,290,000,000,000 from February 27, 2017 ( KRW 2.6 million per month, and KRW 103,290 per month).
From February 27, 2017, the Defendant did not pay two or more vehicles by adding the down payment, deposit, management expenses, etc. from February 27, 2017, and continued to occupy the instant building without complying with the Plaintiff’s request for delivery even though the instant lease contract was terminated due to the Plaintiff’s notice of termination on June 19, 2017.
E. Therefore, the Defendant is obligated to deliver the instant building to the Plaintiff, and the Plaintiff is obligated to pay the amount of money calculated at the rate of KRW 500,000 per month from July 22, 2017 to the completion date of delivery of the said building, equivalent to the Plaintiff’s 2/3 shares (1/2 shares) or the rent equivalent to the Plaintiff’s 1,395,520 shares, and the amount of money calculated at the rate of KRW 1,395,
2. Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);
