Defendant shall be punished by imprisonment without prison labor for a period of one and half years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the captain of Dong-gu Coastal Coast Guard B (total of 9.77 tons).

At around 08:00 on May 7, 2019, the Defendant: (a) departed from the Twit line located in Jung-gu Incheon Metropolitan City, with five crew members; (b) arrived at the sea of approximately 18 nautical miles in the infinite-gun of Incheon Cheongjin-gun, Incheon, for the operation of the coastal self-owned network on the same day; (c) discovered that the coastal self-owned network was operated for a long time on the 15th day of the same month; (d) discovered that the coastal self-owned network was set at the upper and lower end of the same month; and (e) linked the network to the network; and (e) made it possible to correct the network by cutting it into the roll installed at the port of the players roller and the steering boat; and (e) made it possible to correct the network.

이러한 경우 피고인은 작업현장을 전체적으로 통제할 수 있는 조타실에서 조류의 방향, 어망의 장력 및 선원들의 위치를 정확히 파악한 후 조류와 어망의 장력 등을 감안하여 선박의 엔진과 클러치를 적절하게 조작함으로써 작업 중 어망 줄이 장력에 의해 풀리면서 튕기거나 끊어지는 등의 안전사고를 방지하는 등 작업 중에 발생하는 안전사고를 미연에 방지해야 할 업무상 주의의무가 있었다.

그럼에도 불구하고 피고인은 이를 게을리 한 채 승선원들의 작업이 서툴다는 이유로 만연히 선원들과 함께 선수갑판에서 엉킨 주어망줄을 바로잡아 푸는 작업을 하던 중, 같은 날 12:30경 갑자기 엉켜있던 주어망줄이 장력에 의해 풀려 튕귀면서 선수 갑판에서 작업 중이던 피해자 C(52세)의 턱 부위를, 좌현 중앙 갑판에서 작업 중이던 피해자 D(48세)의 복부 부분을, 선수 중앙 갑판에서 작업 중이던 피해자 E(58세)의 왼쪽 허벅지를 동시에 가격하여, 같은 날 14:45경 피해자 C로 하여금 F병원으로 후송 중 후두부 골절 및 뇌출혈 등으로 사망에 이르게 하고, 피해자 D으로 하여금 약 2주간의 치료를 요하는 우측다리...
