The defendant is the captain of the Ulsan-dong-dong-dong-dong-dong-port fishing vessel B (79.83 tons), who is the general manager responsible for the control of fishing operation and the direction and supervision of the safety of seafarers.

이러한 경우, 피고인은 수년간의 저인망어선 선장으로 승선경력이 있고, 과거 2009년 B 선장으로 승선당시에도 양망작업 중 선원 안전사고로 인해 형사처분을 받은 동종전력이 있어 해상에서의 조업시 부주의에 의한 안전사고 발생의 예견가능성을 충분히 인지하고, 저인망그물 양망작업을 함에 있어 양망되는 총 3,000m(그물줄 10마루가 연결된 줄) 길이의 그물줄 중간에 샤클이 연결되어 있어 양망기 드럼에 인양되는 어구(그물줄)의 엉킴 현상이 자주 발생함으로, 엉킨 그물 줄로 인해 양망기 드럼 작동자의 안전사고를 방지하기 위해 그물줄 엉킴 현상 발생 시 작업자로 하여금 양망기 작동을 중지한 후 엉킨 그물 줄을 풀고 난 후 양망기 장비를 재가동하게 하여야 함은 물론 특히 우천 시에는 선원이 입는 우의(雨衣)의 적합성에 대한 사전 점검을 통해 선원 개개인별 신체에 맞는 우의를 착용하게 함으로써 양망기 그물 줄 엉킴 현상이 발생할 수 있는 선원 안전사고를 미연에 방지하여야할 업무상 요구되는 주의의무가 있었다.
