9. 15:09경까지 대전 유성구 E에서 ‘F 게임랜드’를 운영하면서 손님들에게 버튼자동누름장치인 일명 ‘똑딱이’와 함께 게임물등급위원회로부터 등급분류 받은 내용과 달리 발사버튼을 누르지 않더라도 자동으로 총알이 발사되도록 함으로써 게임이용자의 선택 및 조작능력과 무관하게 자동으로 위 게임이 진행되도록 변조된 ‘레드 피쉬2’ 게임기 50대를 손님들의 이용에 제공하여 손님들로 하여금 우연한 결과에 따라 점수를 취득하도록 하고, 위 게임을 통해 점수 5,000점을 취득하면 손님들에게 점수 5,000점이 보관된 무기명 아이템카드를 횟수 제한 없이 경품으로 제공하여 손님들이 이를 환전업자로부터 용이하게 환전받거나 위 카드에 저장된 점수만큼 다시 게임을 할 수 있게 함으로써 시가 5,000원 상당의 교환가치를 부여하는 방법으로 사행행위 영업을 하였다.
