Reasons
Punishment of the crime
The Defendant, on the ground that he had been engaged in activities as the branch head of B’s subdivision from around 2008 to February 2015, 2015, would be able to operate festivals, etc. in both mountain areas by using documents, etc. altered to the victim D (53 tax) by presenting a document, etc.
The author tried to acquire money by fraud.
1. On June 17, 2015, the Defendant, at the Defendant’s house located in Yangsan-si, Yangsan-si, the following: (a) changed a private document and changed a document into “the details of permission for use of Yangsan Culture and Arts Center” recorded in the document file, the name of the president of the facilities management corporation of Yangsan-si, using a computer, as “the details of permission for use of Yangsan-si,” and (b) “the details of permission for use of Yangsan-si,” which read “the details of permission for use of Yangsan-si,” and (c) “the use of Yangsan Culture and Arts Center” as “the use of Yangsan-si, Yangsan-si, the content of which was changed from July 22, 2015 to July 26, 2015, and presented it to the said victim on June 18, 2015.
Accordingly, the defendant, for the purpose of exercising rights and duties, has altered documents in the name of the president of the facilities management corporation.
2. On June 18, 2015, the defrauded presented the document altered as above to the victim, stating that “The victim shall hold at the YYY 2015 up to July 22, 2015 up to July 26, 2015, the Defendant, following consultation with GON-do, Yangsan-si, etc., would receive support payments of an amount equivalent to KRW 240 million from KON-si, and obtained permission for use of Yangsan-si from Yangsan-si, and that “the amount of KRW 23 million is changed at the expense of participating in the event.”
However, at the time, the Defendant presented to the victim a document entirely different from the facts as above, and there was no plan to hold a festival in both mountain areas at the time, and there was no fact that the Defendant had to receive support payments from KONN, etc., and the Defendant was able to pay money from the victim.
