A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal records] On May 29, 2015, the Defendant was charged with non-detained for fraud with the Seoul Central District Court on September 25, 2015, and was legally detained on September 10, 2015. Meanwhile, on March 10, 2015, the Defendant was not detained for a violation of the Act on the Establishment of Local Reserve Forces in Cheongyang-gu District Court, and was sentenced to a suspended sentence of two years on October 15, 2015.

The defendant appealed against each of the above judgments, and the defendant appealed again on January 14, 2016 in the case of the Seoul Central District Court appellate court which was consolidated and sentenced to ten months of imprisonment, and is currently pending in the trial of the court of final appeal.

[Criminal facts] 2015 Gohap 1057

1. On July 1, 2014, around 02:00, the Defendant: (a) provided 100,000 won to foreigners who were unable to know the name on the street of the “D” club located in Yongsan-gu Seoul Metropolitan Government; and (b) 100,000 won to foreign men who were unable to know the name on the street; and (c) 2,000 won

2. The Defendant paid from the “E” club toilet located in Yongsan-gu Seoul Metropolitan Government around 03:00 on the same day as the above 1.3, Defendant 1 smoked in a way that, after putting about about approximately one minute of marijuana purchased as specified in the above 1.3, he added a flusium (one minute) and added a flusium to smoke.

3. On July 14, 2014, around 14:00, the Defendant smoked in a way that, at the Defendant’s residence located in Gangnam-gu Seoul Metropolitan Government F Building 201, the hemp smoking pipe created with G, H, and I (one person J) together with G, H, and I (one person J) was added to the marijuana smoking pipe purchased as described in the foregoing 1.

4. On August 16, 2014, around 20:00, the Defendant sent to Kwikset service article, who was named “L hotel” on the front side of the “L hotel” in Gwangjin-gu Seoul Special Metropolitan City, via the former Messenger, and sent KRW 50,000 in cash to Kwikset service article, and approximately KRW 3g of marijuana from Kwikset service article.

5. The defendant 23:00 on the same day as the above 4. paragraph 4. At the swimming toilet of "L hotel" located in K in Gwangjin-gu Seoul Special Metropolitan City, he puts the fluor amount ( approximately 1 minute) among marijuana purchased as above 4. The defendant 3:0 into tobacco.
