A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who violates the Immigration Control Act shall arrange or solicit the employment of foreigners who have no status of sojourn eligible for employment activities in the Republic of Korea, as prescribed by Presidential Decree;

A. From September 7, 2017 to September 18, 2017, the Defendant: (a) provided that “F”, which was known to the Defendant’s wife at a business establishment where the game was held in Tranma Ba-si B, was 1.5 million won for the said Mina-si G with the employment of the said Mina-si G by receiving KRW 1.5 million from the Defendant’s wife via “E on the mobile phone conversation.”

B. From September 13, 2017 to September 14, 2017, the Defendant arranged employment on the condition that he receives 500,000,000 won from the real name in the instant marina room, which he/she came to know in the instant database room in Korea through the “E on mobile phone conversation.”

C. At around 06:00 on October 18, 2017, the Defendant: (a) reported on the advertisement, and arranged employment by having L, “I want to get a massage club to work at a Korean marina shop”; (b) received 50,000 fee (170,000 won) from Korea, and let the victim enter Korea via Incheon Airport; and (c) notified the address of the business place in the Mariman branch, which was promised to arrange for the victim as “E,” which is a mobile phone conversation, known the address of the business place in the Mari branch, and took a taxi to find it.”

As a result, the defendant arranged and recommended the employment of foreigners who do not have the status of sojourn eligible for employment activities as a business.

2. Any person who has violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. shall not introduce or mediate an occupation to cause sexual traffic and shall not pay the price for such occupation;
