The judgment below

Examining the reasoning in light of the record, it is justifiable for the court below to reverse the judgment of the court of first instance on the ground that there is no evidence of crime as to the sale of philophones among the facts charged in this case, and to render a not guilty. In so doing, the court below did not err by exceeding the bounds of the principle

In addition, the prosecutor appealed against the guilty portion of the judgment of the court below, but did not submit any grounds for objection.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
