1. The Defendants enter into an agreement on August 20, 1997 with respect to shares of 1/4 of each of the real estate listed in the separate sheet to the Plaintiff.
Reasons
1. Basic facts
A. On May 2, 1966, the Plaintiff married with Nonparty D, and was born as his child, E, Defendant B, Defendant C, and F, and died on June 23, 2013.
B. From the beginning of 194, while being married with the Plaintiff, the deceased D was actually living together with Nonparty G while maintaining an inappropriate relationship with the Plaintiff, and as a matter, it drafted a written agreement and a letter to the effect that, around three times on March 3, 1996, the Plaintiff and the Plaintiff are demanding not to interfere with the Plaintiff’s privacy, and that each real estate listed in the separate sheet (hereinafter “instant real estate”) will be transferred to the Plaintiff.
C. After that, the plaintiff and the deceased D entered into an agreement with a notary public on August 20, 1997 on the following terms as of May 20, 1997 as of 2432, 197:
(hereinafter referred to as “instant agreement”): D Address in Young-gu, Busan Metropolitan City: D: The above two persons wish to accept any civil or criminal measure of the following, if they agree and are unable to comply with the agreement:
- Asia - Paragraph 1 D and A shall not interfere with each other's privacy.
Paragraph 2 A does not provide all the damage caused by telephone or physical or mental harm to G and family relatives living with D, and if the damage was inflicted upon G and family relatives by mental or physical means, it would comply with D's desired divorce without any reason. In case of divorce, property division and divorce compensation can not be claimed in entirety.
Paragraph 3 (3) A shall comply with the foregoing Paragraph 2 when he/she takes place even a telephone or mental or physical damage.
When Paragraph 4 A wishes to divorce by agreement without any physical damage by telephone or by mental or physical means, approximately 78 square meters and approximately 130 square meters of H site in Busan City/Do.
