피고인과 B는 2013. 5. 1. 06:50경 부산 부산진구 C에 있는 D식당에서 다른 테이블에서 식사를 하던 피해자 E(23세)이 쳐다본다는 이유로 화가 나 B는 주먹으로 피해자의 얼굴을 1회, 머리를 3회 때리고, 피고인은 주먹으로 피해자의 얼굴부위를 3~4회 때리고 발로 피해자의 오른쪽 옆구리부위를 1회 찼다.
