Defendants shall be punished by a fine of KRW 5,000,000.

In the event that the Defendants did not pay the above fine, each of them is 100.

Punishment of the crime

1. Defendant A

(a) No person who violates the Act on Special Cases concerning Regulation and Punishment of Speculative Acts, Etc. shall engage in any speculative act using slot machines or speculative gaming machines in addition to the speculative business under Acts;

Nevertheless, from September 2017 to September 12, 2017, the Defendant installed 30 games of “Yeamato” games, which are speculative machines, in the said game site in Seodaemun-gu Seoul, Seoul, and the first underground floors, and operated a game by using the method of operating the game machine by receiving cash from many unspecified customers who found the place and filling it in the charging card and making them incur economic profit or loss according to the arrangement of the numbers shown on the game screen, and without deducting points obtained by customers from the game result, and exchanging the points in cash.

Accordingly, the defendant was engaged in speculative activities using speculative gaming machines as a business.

(b) No person who violates the Educational Environment Protection Act shall engage in speculative businesses in educational environment protection zones to protect the health, sanitation, safety, learning, and educational environment of students;

Nevertheless, from September 2017 to September 12, 2017, the Defendant engaged in speculative activities, such as the entry in paragraph (a), in the above game site, which is an educational environment protection zone located within 65.21 meters from the boundary of D middle schools.

2. Defendant B, at the date and time, at the place specified in paragraph (1) of Article 1, the Defendant settled daily sales account books of the game room run by A and managed daily sales, thereby enabling the illegal gambling game room operated by A to be operated smoothly.

Accordingly, the defendant made it easy for the defendant to commit the crime A, and prevented it.
