피고인은 2016. 9. 4. 18:53경 불상의 장소에서, 피해자 B(여, 47세)가 자신의 남편과 바람을 피운다고 생각하여 피해자에게 ‘그래. 이번은 그냥 넘어간다. 하지만 두 번 다시 이딴 일 있을 땐 진짜 중국인 고용해서 쥐도 새도 모르게 죽여 버릴 테니깐 각오해'라고 문자를 보낸 것을 비롯하여 별지 범죄일람표와 같이 5회에 걸쳐 문자메시지를 보내 피해자를 협박하였다.
