1. The Plaintiff:

A. As to Defendant A Co., Ltd., the amount of KRW 1,076,00,00 and KRW 950,613,90 among them, the amount of KRW 1,076,00 shall be from September 1, 199.

1. Facts of recognition;

A. On August 17, 199, an open mutual savings and finance company (hereinafter “heat mutual savings and finance company”) entered into an agreement with E Co., Ltd. (hereinafter “E”) to lend KRW 9,700,000,000 per annum; KRW 15% per annum; KRW 1,200,000 until September 20, 199; KRW 2,000,000 until October 2, 199; KRW 2,000,000; and KRW 2,00,000,000,000 until November 2, 299; and KRW 2,00,000,000 until December 2, 199; and KRW 2,00,000,000; and KRW 30,000; and KRW 50,000 per annum (hereinafter “the loan”).

Defendant B, C, and F have jointly and severally guaranteed KRW 1,200,000 out of the above loans on the same day.

B. On August 31, 1999, the open mutual savings and finance company entered into a bill transaction agreement with E with the content that the credit limit amount is KRW 1,260,000,000, the transaction period is from August 31, 199 to August 30, 200, the interest rate is 18% per annum from August 31, 1999 to October 2, 199, and 23% per annum from October 3, 199 to the day of full payment (hereinafter “the second loan agreement”), and loans KRW 1,260,000,000 for the bill discount to E on the same day.

Defendant D guaranteed the debt of the above loans on the same day.

C. On February 11, 2000, E, the primary debtor of each of the instant loan agreements, changed its trade name to G Co., Ltd., and changed its trade name on March 27, 2000 to Defendant A Co., Ltd. (hereinafter “Defendant A”).

On July 28, 2000, the open mutual savings bank was declared bankrupt by the Daegu District Court and the Korea Deposit Insurance Corporation was appointed as a bankruptcy trustee.

E. On August 30, 2004, the Korea Deposit Insurance Corporation filed a lawsuit against the Defendants and F with the Daegu District Court No. 2004Kadan103211 against the Defendants and F, demanding the payment of the principal and interest of the loan under each of the instant loan agreements.

(f) The above court is against the Plaintiff on January 6, 2006.
