A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
The defendant had been living together with the workplace E in the Asan-si Dispute Resolution Co., Ltd., 104, 510-dong 510, in order to prepare the personal living expenses in the case of Asan-si, in order to use the credit card under the name of E.
1. On January 2012, the Defendant entered the aforementioned C Apartment 104 510 dong 510 as a member at the Internet site of the Defendant’s Nowon-gu in which E’s certificate was kept, using the Defendant’s Nowon-gu in which E’s certificate was stored, and then entered the personal information and address of E in the application for the issuance of credit cards, and the mobile phone number in the name of E in which the Defendant was in use, and then transmitted it to the Defendant during the period from that time to January 26, 2012, including sending it, as shown in the list of crimes, from that time to January 26, 2012.
Accordingly, the Defendant, with the aim of making the business process smooth, forged the special media records, such as E, related to rights and duties, and exercised them.
2. The Defendant: (a) around January 17, 2012, the Defendant: (b) did not have consented to the issuance of a credit card under his/her name; and (c) despite that, as stated in paragraph (1), E applied for the issuance of each credit card under the name of the victim, as if E applied for the issuance of a credit card, the Defendant issued a credit card from the victims; (d) obtained a credit card; and (e) obtained a credit card from the victims to February 22, 2012 using a new card from January 17, 2012 to February 17, 2012; and (e) obtained a total of KRW 1,256,146 won using a new card; and (e) obtained a total of KRW 2,029,595 won using a modern card; and (e) obtained a total of KRW 5,022,872,872 by using the Samsung card; and (e) equivalent to KRW 8,308,613.
