1. The Defendant: KRW 19,515,778 to Plaintiff A; KRW 3,00,000 to Plaintiff B; KRW 500,000 to Plaintiff C, D, E, and F, respectively.

1. Presumed factual basis

A. The parties concerned are those who suffered an injury by assaulting the Defendant, and the spouse of the Plaintiff A, and the mother of the Plaintiff A, the Plaintiff D, the E, and the F are the children of the Plaintiff.

나. 피고의 원고 A 폭행 피고는 2018. 7. 6. 22:30경 강원 인제군 H 지하 1층에 있는 ‘I’ 단란주점 6번방에서 원고 A 등과 술을 마시던 중 원고 A가 술값을 내기로 하였으나 술값을 내지 않자, 원고 A에게 “예전에 나한테 했던 말 기억하나, 내년에도 술을 안사면 개새끼라고 말했는데 이번에도 술을 안 샀으니 개새끼 맞네”라고 말하였고, 원고 A는 “뭐라고 이 새끼야”라고 말하면서 맥주병을 피고를 향해 던졌다.

이에 피고는 원고 A에게 “왜 맥주병을 던지냐”라고 말하였고, 원고 A가 손으로 피고의 뺨을 때리자, 피고도 주먹으로 원고 A의 얼굴 부분을 1회 때렸고, 원고 A가 그로 인하여 ‘쿵’ 소리를 내면서 바닥에 넘어지면서 머리 오른쪽 부분(오른쪽 귀 부분)이 바닥에 부딪쳤다.
