A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
The defendant has been working as the director of the Cmina D Site Management Office by up to 2001, and is currently operating convenience points.
1. On April 1, 2010, the Defendant: (a) received KRW 7 million in cash and checks from G at the front of the Defendant’s house located in Jung-gu Incheon, Jung-gu, Incheon; (b) received KRW 7 million in cash and checks from G; (c) requested the employment of the said E at H in the middle-gu Incheon, Jung-gu, Incheon; and (d) granted KRW 3 million in cash to I, who was the head of the D Site Management Office, was employed as a member of the D Site Management Office.
As a result, the defendant involved in the employment of another person for profit or obtained benefits as an intermediary, and he made an illegal solicitation and provided property in relation to the employment duties of the members of the above I C'D Site Management Office.
2. On July 6, 2010, the Defendant: (a) received KRW 7 million from G as a check at the front of the public bus terminal in Incheon Reinforcement-gun, Incheon; (b) received KRW 7 million as a check at the request of G to request for the employment of J from the K-gun, and (c) requested the above J to be employed at the above H H road management office on July 8, 2010; (b) granted KRW 3 million in cash to I, who was the head of the D-based management office; and (c) granted KRW 3 million as a member of the D-site management office on August 16, 2010.
As a result, the defendant involved in the employment of another person for profit or obtained benefits as an intermediary, and he made an illegal solicitation and provided property in relation to the employment duties of the members of the above I C'D Site Management Office.
3. L employment-related L. (Violation of the Labor Standards Act) around January 201, the Defendant received KRW 7 million in cash and check from G upon request from G to request for employment in the front of the above K Bus Terminal. Around that time, the Defendant received KRW 7 million in total from L.C. D site management office.
