1. The defendant shall be punished by imprisonment for a period of two years and six months;

Reasons
Punishment of the crime
The defendant is an incorporated association in Seoul L Mhoho and N, and the actual representative of the KUP.
1. No person who violates the Act on the Regulation of Fraud and Similar Receiving Acts relating to mobile phone sales business shall make an agreement to pay the total amount of investments or an amount in excess thereof to many and unspecified persons in the future without obtaining authorization, permission, etc. or making registration, report, etc.;
Nevertheless, the Defendant, while engaging in volunteer activities with the members of many churches, introduced himself/herself as a professor of a domestic famous university, introduced 12 members of a domestic famous large church as an adviser of the aboveO, and obtained trust by displaying his/her television contribution page related to Q, followed by using such trust in order to receive contributions as an investment for mobile phone sales business.
On September 15, 2014, the Defendant recognized that “an investment of KRW 120,00 in the name of a bridge related to the last time service or an investment of KRW 120,000 in the opening incentive received from a radio operator if he/she has invested in one mobile phone” against the victim R, etc. at the office of the said incorporated association around September 15, 2014, and thereafter, if he/she invests KRW 120,000 in his/her subordinate investors or three persons are recruited to invest KRW 120,000 in the missionary work or to join the mobile phone, the Defendant may receive KRW 10,00 out of the investment funds of the investors or the mobile phone subscribers up to KRW 12,00,0
A false project explanation meeting was held to the effect that if 30,000 won is invested and 30,000 won is recruited, it would enable 81,90,000 won to be received as above.
However, there is no separate benefit from the project explained by the defendant, and eventually, it receives investment money from the subordinate investors.
