1. On April 16, 2015, Defendant A was the head of the headquarters of the National Democratic Labor Union Federation (hereinafter “Private Labor Union”) AJ regional headquarters. After closure of a business, Defendant AK (State), a subcontractor of the Republic of Korea, intended to hold an unreported assembly to urge AK (State), an original contractor, who did not pay wages and retirement allowances to workers, including employees belonging to the Civil Labor Union, to succeed to employment and to pay unpaid wages and retirement allowances on behalf of the employees.

A person who intends to hold an outdoor assembly or demonstration shall submit a report stating the purpose, date, time, place, organizer, etc. to the head of the competent police station from 720 hours to 48 hours before commencing the outdoor assembly or demonstration.

Nevertheless, Defendant A did not report the assembly to the head of the competent police station on April 16, 2015, from around 10:30 to around 11:10 on the same day, Defendant A took part in the community of the director general of the headquarters of the Republic of Korea AJ headquarters and the director general of the regional headquarters of the headquarters of the Republic of Korea and AJ headquarters, and 30 members of the headquarters of the Republic of Korea and AJ headquarters, including Defendant A, took part in the speech and press conference.
