A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 일명 ‘C ’으로부터 피고인 명의로 차량 장기 임대계약을 체결한 후 차량을 넘겨주면 대출을 해 주겠다는 제안을 받고, ‘C’, D 등과 공모하여, 2015. 4. 24. 경 대구 서구 E에 있는 의류업체 ‘F ’에서 피해자 주식회사 SK 네트 웍스 담당 직원에게 ‘ 그 랜드 스타 렉스 1대를 장기 임대하면서 매월 464,546원 상당의 임대료를 지급하고 임대기간인 48개월 후에 위 차량을 반환하겠다’ 는 내용의 차량 임대차 계약서를 제출하여 이에 속은 위 피해 회사로부터 2015. 5. 11. 경 시가 26,050,000원 상당인 G 그랜드 스타 렉스 1대를 교부 받은 것을 비롯하여, 그 무렵부터 2015. 6. 2. 경까지 별지 범죄 일람표 연번 7, 8, 18, 19 기 재와 같이 4회에 걸쳐 합계 100,140,000원 상당인 자동차 4대를 교부 받아 편취하였다.
