The prosecution of this case is dismissed.

1. On October 11, 2012, the Defendant committed assault by assaulting the victim by hand on the part of his hand on the ground that the victim D, who is a dementia patient, was suffering from disturbance at the 508 room of the fifth fifth floor of the C Hospital in Goyang-gu, Goyang-gu, Goyangyang-gu. Around October 11, 2012.

2. The above facts charged cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(2) of the Criminal Act. According to the records, the victim expressed his/her intent not to punish the defendant around January 17, 2013, which was after the prosecution of this case, and thus, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act. It is so decided as per Disposition.
