The prosecution of this case is dismissed.

On March 19, 2013, around 19:30 on March 19, 2013, the Defendant: (a) committed assault against the victim C (the age of 57) in drinking alcohol in the area of the victim C (the age of 57) located in Suwon-gu, Busan; (b) determined that “Isn't drink and drinking,” and that “Isn't have a sexual intercourse; and (c) assaulted the victim’s part of the charge by drinking alcohol.”

Judgment

This part of the facts charged cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(2) of the Criminal Act. Since the victim expressed his/her wish not to punish the defendant on April 4, 2013, which was after the prosecution of this case, around April 4, 2013, the prosecution of this case is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
