1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The defendant shall be an incorporated foundation established by C to manage the properties of a church that belongs to a different religious order.
On March 1, 1993, the Plaintiff was employed as a member of the lower court, by developing a Fcademy, a member of the D E society affiliated with C, which is an individual of the E society.

On July 1, 1996, the registration of ownership transfer was completed under the Plaintiff’s name on May 18, 1996 with respect to the real estate listed in the list No. 1, and thereafter, the registration of ownership transfer was completed under the Plaintiff’s name on October 20, 1997 with respect to the real estate listed in the attached list No. 2, which was the third floor neighborhood living facilities and the housing on the land.
The plaintiff transferred the above F church to the location of each real estate listed in the attached list (hereinafter referred to as "each real estate of this case") and established a H church, which is an individual church under C's D's affiliated organization, and used each of the real estate of this case as the dividend of H church and its site.
On November 28, 1997, each registration of ownership transfer (hereinafter “each of the instant registrations”) was completed on November 17, 1997 under the name of the Defendant on the real estate of this case.
C Of the Constitution, the articles of incorporation, and the management office regulations, the contents of this case are as follows.
[C] Article 28 (Property Management) (1) The real estate owned by the individual church, institution, or organization belonging to C shall be registered and managed in the name of the defendant.
[The purpose of Article 3 (Purpose of the Defendant’s Articles of Incorporation) is to own and manage all churches belonging to C, and land, buildings and equipment necessary for education, rescue and relief, childcare facilities, and other social edification and volunteer projects operated by these churches, and to supply necessary property.
Article 19 (Management of Properties) (2) Where intending to dispose of (sale, donation, or exchange) fundamental property, it shall go through the procedures for permission to modify the articles of incorporation under Article 29 (Amendment of Articles of Incorporation).
[Defendant Management Affairs Regulations] Article 2 (Property Ownership and Membership) (1) The ownership of all real estate belonging to a church belongs to the defendant, and the defendant belongs to the church.
