Reasons
Punishment of the crime
1. No person who violates the Foreign Exchange Transactions Act shall export or import means of payment not less than 10,00 U.S. dollars or securities without filing a report or after filing a false report;
A. On February 18, 2019, the Defendants and C conspired with C to make a false declaration of the travel expenses by dividing the amount of USD 700,000 in Hong Kong ($ 1600,000, US$89,000, US$1600, US$89,000), which is to be used as the “refiting money” capital, from the Republic of Korea to China through the Jung-gu Incheon International Airport via the Jung-gu Incheon International Airport (272 Incheon), with C, and then Defendant B exported USD 100,00 without filing a report, and Defendant A and C respectively filed a false declaration of the Hong Kong USD 300,000,000 as the “ travel expenses” and exported it.
Accordingly, in collusion with the above C, the Defendants filed a false declaration and exported the Hong Kong USD 600,000,000, which is the fund of the “Refunding”.
B. On February 26, 2018, the Defendant: (a) left the Republic of Korea through the Incheon Jung-gu Incheon International Airport through the 272 Incheon International Airport; (b) on January 11, 2019, the Defendant filed a false report on the travel expenses; and (c) exported the KRW 70,000,000 ($ 54,60,000,000,000,000,000,000) for the purchase of virtual currency, which was received from a person who was not related to his/her name, in the street near the 4, 4,000 Seo-gu, Incheon, Seo-gu, Incheon; and (d) the Defendant filed a false report on the travel expenses, and filed a false report on the departure expenses to Hong Kong.
3) On February 2, 2019, the Defendant filed a false report on the travel expenses with the amount of USD 9,000,000,000,000,000,000, which is to be used as the “refaction” fund through the 272 Incheon International Airport, to the Jung-gu Incheon International Airport (Korean, USD 1,80,000,000,000,000,000,000,00
