A defendant shall be punished by imprisonment for not less than eight months.
Of the facts charged in the instant case, 485,754.
Reasons
Punishment of the crime
On June 2015, the Defendant: (a) was operating the Internet club of “D”, and (b) became aware of the victim B (at that time, 40 years of age) who was a member of the said club; (c) was aware of the victim’s name; and (d) was aware of the G of F, a hedge fund company of the United States, Hong Kong investment company; (d) was established in Korea, and (e) became aware of the investment company of the Republic of Korea; (c) was in Korea and its company was entrusted to operate; and (d) purchased a large amount of money with stocks investment; (d) purchased high-priced external systems, such as events and lelaber, etc. with its profits; and (e) made the victim believe that the Defendant was a stock investment specialist and has been an unmarried victim and has been married.
In addition, on July 2, 2015, the Defendant received 10 million won from the victim on July 3, 2015, 2015, on the following grounds: “The Defendant may receive profits equivalent to 480% of the principal after the month when H made an investment at the time when H made an investment in the capital increase for the capital increase, and the executives at home are also well aware of the internal information, and the probability of the failure of the investment is zero percent, but even if it is erroneous, the Defendant will guarantee the principal and interest even if it is erroneous.”

However, the defendant did not have the intent or ability to pay the victim the profit equivalent to 480% of the principal by investing the capital increase with capital increase of the above company.
After all, the defendant deceivings the victim as above and acquired 93 million won as the investment for capital increase with stocks.
