A as the representative director of Gangseo-gu Seoul Metropolitan Government B, a person in charge of overall management of the above company, and Defendant B is a corporation established for the purpose of collecting and transporting building waste materials.

Anyone who intends to dispose of wastes shall collect, transport, and keep wastes separately according to the kinds, character, condition of wastes, recyclability or combustibility, etc., and comply with the standards and methods for disposal of wastes, such as incineration, etc.

그럼에도 피고인 A은 1톤당 약 130,000원(2011년 기준)이 소요되는 가연성 폐기물의 처리비용을 절감하기 위하여, 건설공사장 등에서 반입한 폐목재, 폐합판, 폐합성수지, 폐플라스틱, 폐비닐 등의 폐기물을 가연성 또는 불연성 여부 등에 따라 제대로 구분하지 않고, 대형 가연성 폐기물만 분리한 채 나머지는 포클레인을 이용하여 잘게 부수고 다른 성상의 매립 대상 폐기물과 의도적으로 혼합하는 방법(속칭 ‘비빔밥’)으로 1톤당 약 27,000원의 반입수수료만을 지급하고 인천 서구 D에 있는 수도권매립지관리공사 운영의 수도권매립지로 반입하여 매립케 하기로 마음먹었다.

1.
