1. Facts of recognition;

A. The defendant is the party. 1) The defendant is the Hancheon-si, Hancheon-si, Hancheon-si, 568-1 and 47 lots of land, Hancheon-gu, Hancheon-ri, Inc. (hereinafter referred to as the " Hancheon-si, Hancheon-si,

(1) A trust made from a trust and on the ground (hereinafter referred to as “instant resort”).

(2) The Plaintiffs are those who have paid membership fees to Korea’s Round in order to purchase the instant resort.

B. On June 23, 2010, the Korea Job World and the Defendant’s management-type land trust contract was concluded between the Defendant and the Korea Job World and the Korea Job World Shipbuilding Co., Ltd. (hereinafter “Korea Job World Co., Ltd.”). On June 23, 2010, Korea Job World Co., Ltd. (hereinafter “Korea Job World Co., Ltd.”); the trustee; the Defendant; the first priority beneficiary; and the second priority beneficiary.

) A management-type land trust contract (hereinafter “instant trust contract”)

(2) At the time of entering into the instant trust contract, the management-type land trust agreement (Evidence A 18) prepared is written with the following contents.

① The instant trust agreement is only to carry out the business of a trustee with the trust real estate as a trust property to the extent that it is managed and sold in accordance with the terms and conditions set forth in this agreement, and only to carry out the business as an executor of the trust business within the extent that it is managed and sold in accordance with the trust agreement. The purpose of this case is to determine the rights and obligations of the parties in entering into a contract with a land trust with no responsibility for any and all disputes regarding the financing and construction defects

(2) All project costs required for trust projects shall be procured from the truster's responsibility and the trustee shall not be liable to procure or redeem project costs (Article 17 (1)).
