Reasons
1. Basic facts
A. 1) F Co., Ltd. (former trade name: G Co., Ltd.; hereinafter “F”)
(A) On August 16, 2016, the term “instant building” refers to a building consisting of main complexes on the I ground of Suwon City from H on August 16, 2016.
) New construction works (hereinafter “instant construction works”)
(2) A contract for construction works (including value-added tax) that the construction period of which was fixed from August 22, 2016 to August 30, 2017 and that was contracted as the contract amount of KRW 4,872,200,00 (hereinafter “instant contract for construction works”).
2) After November 11, 2016, the Defendant entered into a management-type land trust contract (hereinafter “instant trust contract”) with H, F, etc. as of November 11, 2016. For the construction and sale of the instant building, the Defendant entered into a management-type land trust contract (hereinafter “instant trust contract”) with H, trustee: Defendant, joint first beneficiary: J, K, and L Co., Ltd. (hereinafter “joint first beneficiary”), and construction company: the main contents are as follows.
Article 1 (Purpose of Trust) of the Management-type Land Trust Contract (Purpose of Trust) ① The purpose of this trust is to entrust the trustee with the 710.5 square meters square meters (hereinafter referred to as the "trust land") in Suwon-si, Suwon-si, and the trustee takes over it and constructs the building on the trust land and then sell the land and buildings (hereinafter referred to as the "trust real estate") as trust property (hereinafter referred to as the "trust project").
(2) A trust contract shall be performed only by a trustee who takes the trusted real estate as trust property and holds the status of a trust project operator within the scope of managing and selling it in accordance with the terms and conditions stipulated in this contract, and a trust contract shall be concluded with a land trust with no responsibility for any dispute on the procurement and execution of funds necessary for the execution of a trust project, dispute related to a contract for sale in lots, dispute related to a contract for sale in lots, and settlement of civil petitions.
