A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
Around May 30, 2013, the Defendant was sentenced to the suspension of the execution of ten months in the Incheon District Court on August 6, 2013, and the judgment became final and conclusive around that time, on the following grounds: “In the vicinity of the new forest of Guro-gu Seoul Metropolitan City on May 30, 2013, the Defendant purchased 30 smartphones that he stolen from D through an advertisement for the purchase of lost or stolen mobile phones on the Internet site to 2.3 million won.”
Criminal facts
From May 2013, the Defendant: (a) from around 2013 to around 2013, on the Internet website, the Defendant: (b) opened a business of purchasing and selling stolen mobile phones by means of mass gathering of cell phoness that cannot be normally traded due to theft, loss, etc. from the seller discovered by communicating with the name of the vehicle, such as E, or by using the stolen prepaid phone; and (c) disposing of it by means of transporting it to China via Pyeongtaek-si Port.
1. On May 26, 2013, the Defendant, and the Defendant’s name-based joint criminal activity: (a) purchased the Defendant’s advertisement with the Defendant’s name-free male around the Defendant’s bank near the said new forest basin, and with the Defendant’s name-free male on his/her name-free male, who f. G, even though he/she was aware that it was a stolen object, at least one million won at the gallon market price of Samsung Y4 Smartphone, which he/she stolen, and the amount equivalent to KRW 200,000,000,000 won at the Samsung Tgal ju S4 Smartphone market price owned by the Defendant and KRW 3.2 million.
Accordingly, the defendant acquired stolen goods in collusion with the above name in return for the defendant.
2. The Defendant committed the Defendant’s crime at around May 31, 2013, around the 2013 am, around 30 smartphones (24 million won), including Samsung Ggal jus-2, etc., owned by the victim J, and 4.8 million won at the 6 smartphones (4.8 million won) market value owned by the victim K, and SY owned by the victim.
