피고인은 2014. 11. 29. 14:08경 인천 남동구 청능대로 596에 있는 홈플러스 지하1층 8번 계산대 앞에서, 그곳에서 물품을 구매하기 위하여 방문한 손님인 피해자 B(여, 45세)이 물품대금을 결제하는 과정에서 계산이 제체되어 시간이 오래 걸린다는 이유로 시비를 하던 중 화가 나 피해자의 딸(6세), 홈플러스 보안요원 C 및 계산대 직원 등 여러 사람이 지켜보는 가운데 피해자에게 "씨발년, 썅년, 좆같은년, 죽여버린다"라고 큰소리로 욕설을 하여 공연히 피해자를 모욕하였다.
