1. Basic facts

A. The defendant is a non-profit foundation established by the joint contribution of the Ministry of Trade, Industry and Energy and Incheon Metropolitan City for the purpose of developing industrial technology complexes and supporting technology enterprises, etc. under the Act on Special Cases concerning Support of Technoparks and the Ordinance on the Establishment and Support of the Songdom Park, Incheon Metropolitan City.

The plaintiff is a company that engages in industrial design, product design, etc.

B. The Defendant’s bid announcement 1) The Defendant offered a bid for proposing the design and construction of the exhibition room in the Ecoland public relations center located in the Rocoland, Spanish-gun, Incheon Spole-gun on October 6, 2015 (hereinafter “instant bid”).

The public notice of the instant tender was made. The Local Contract Act on the Contracts to Which a Local Government Is a Party (hereinafter “Local Contract Act”).

(2) The Plaintiff, A, B, and C, etc. submitted a proposal and participated by four companies, including the Plaintiff, A, B, and C, in accordance with Article 6-2 of the Local Contract Act.

The Defendant’s selection of potential concessionaire and conclusion of the instant construction contract) as the result of the Defendant’s announcement of the proposal and its evaluation on October 28, 2015, the Defendant assessed A as a potential concessionaire the sum of 92.93 points, including 19.5 points in quantitative evaluation, 5.43 points in positive evaluation, 2 points in positive evaluation due to delay and submission of a summary of technical proposals, and 20 points in conversion points based on the bid price, and 18.51 points in total, including 18.75 points in quantitative evaluation, 34.86 points in emotional evaluation, and 18.90 points in conversion based on the bid price. 2) The Defendant assessed the Plaintiff as a potential concessionaire on November 26, 2015, with the contract amount of 177,000,0000 won between A and the contract period of the construction contract from November 26, 2015 to the exhibition site construction contract (hereinafter “construction contract”).
