1. The contract to establish a right to collateral security concluded on August 28, 2012 between the Defendant and C regarding the real estate stated in the attached list.

1. Basic facts

A. The Plaintiff and C have made a monetary transaction from around 2006 to November 2012. On October 20, 2012, the Plaintiff and C drafted a letter of payment with the purport that “10 million won would be paid on November 10, 2012, and the balance would be KRW 3307 million.” 2) The Plaintiff filed a lawsuit against C seeking payment of the said loan under Seoul Central District Court 2013Gahap14069. On November 15, 2013, the said court rendered a judgment that “C shall pay the Plaintiff a loan of KRW 430,760,000 and its amount at the rate of 20% per annum from January 30, 2013 to the date of full payment.”

3) On the above judgment, C appealed as Seoul High Court 2013Na203746, but the above court dismissed C’s appeal, and C filed a final appeal on September 4, 2014 and is currently pending in the lawsuit. (b) On April 10, 2008, C purchased real estate listed in the separate sheet from Nonparty E (hereinafter “instant real estate”) and purchased KRW 50,000,000 from Nonparty E in the separate sheet for KRW 30,000,000,000 on the date of the contract, and concluded a sales contract to pay KRW 130,00,000 on April 30, 2008, the remainder amount of KRW 390,000,000 on May 16, 2008.

2) On April 25, 2008, C received the registration of ownership transfer for the instant real estate from the above E, and thereafter paid the purchase price in full to the above E. Meanwhile, C received from the Defendant on May 6, 2008, the payment of KRW 1.55,000,000 from the Defendant on May 6, 2008, and used the payment of the said purchase price. 3) The Defendant lent the said amount to C on August 21, 2006, by remitting KRW 100,000,000 to C, and C paid KRW 1.5 million or KRW 1.2 million as of September 25, 2006 to April 30, 2008.

On May 30, 2008, C and the Defendant settled C’s loan obligations at KRW 75,000,000 in consideration of the repayment of interest as above by C on May 30, 200.
