A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant is a person who was sentenced to ten months of imprisonment with prison labor on November 28, 2014 by the Seoul Eastern District Court on March 13, 2015 and completed the execution of the sentence in the Sungdong Prison on March 13, 2015.

[Criminal facts]

1. On April 1, 2016, the Defendant: (a) 21:00, the Victim D’s “E main store” in the Gyeonggi Gyeonggi-gu World Trade Group C was committed as if the Defendant were to pay the amount properly; and (b) ordered the Victim to provide alcohol and alcohol.

However, in fact, the Defendant did not have any money at all, and there was no other method to pay the drinking value, and thus there was no intention or ability to pay the said price even if he received the drinking from the injured party.

The Defendant, as such, by deceiving the victim, received a total amount of 200,000 won from the injured party.

The Defendant: (a) caused damage to property and interference with his duties at the time and place specified in paragraph 1; (b) caused the disturbance to the customers who were in such place to leave the scene, such as: (c) the victim’s booms, which was placed on that place, to damage the floor by cutting 10 stump of the market value, which was the victim’s possession thereof; and (d) dumping them with a large volume of sound; and (c) caused them to leave the scene.

Accordingly, the defendant damaged the victim's property and interfered with the victim's main business by force.
