1. The Defendant: KRW 36,732,439 for the Plaintiff and KRW 5% per annum from December 13, 2016 to June 20, 2019.

1. Facts of recognition;

A. On December 13, 2016, around 21:00, the Plaintiff was on board the back seat of the vehicle that the Plaintiff her husband drive in the vicinity of the Busan High-dong Intersection in Busan High-gu, U.S., Busan, and was injured by the Plaintiff due to drilling of the sea-going vehicle in the signal atmosphere.

(hereinafter “instant accident”). The Defendant is an insurer for a sea-going vehicle.

B. The Plaintiff received hospital treatment for two days immediately after the instant accident, and paid the sum of KRW 5,065,668, including receiving hospital treatment (which is the medical expenses received from hospital other than the C oriental medical hospital).

The Defendant paid KRW 3,810,640 to the Plaintiff’s medical expenses at C.C. oriental medical hospitals.

C. The following was confirmed as a result of the physical appraisal of the Plaintiff.

1) The Plaintiff suffered from the injury to the conical chroat, and the symptoms, such as the current pain, etc., among the 4-5 pages in the 19th century. This is determined to be caused by the instant accident. 2) In the case of the escape symptoms of the conical signboards, the labor ability loss rate of 23% due to the one-year temporary disability (50%) and the labor ability loss rate of 24% due to the one-year temporary disability in the case of the conical chroat.

3. The future treatment shall be necessary for one year, and its cost shall be estimated to be 3,382,840 won.

On the other hand, at the time of the instant accident, the Plaintiff was paid KRW 2.93 million monthly wage as a company member.

2. Determination:

A. According to the above fact of recognition of the liability for damages, the defendant is liable to compensate the plaintiff who is the victim as the insurer of the damage vehicle for the damages incurred by the accident in this case.

B. It is difficult to find out circumstances to limit liability for damages in the instant accident limiting liability for damages.
