피고인은 2014. 10.경 의정부교도소에서 노역장 유치 중 성명불상자로부터 인터넷 웹사이트에 향정신성의약품인 메트암페타민(속칭 ‘필로폰’, 이하 ‘필로폰’이라 함)을 지칭하는 은어인 ‘작대기’, ‘아이스’, ‘얼음’ 등을 사용하며 필로폰을 팔겠다는 내용의 글을 올리고, 이를 보고 연락을 하는 사람들로부터 금원을 송금 받은 후 필로폰을 교부하지 않는 방법으로 금원을 편취하는 수법을 배우게 되었고, 2015. 3.경 경기 의정부시 C에 있는 ‘D’ 가게에서 위 떡볶이 가게에서 함께 아르바이트를 한 사이인 E와 위와 같은 방법으로 불특정 다수의 피해자들로부터 금원 편취하기로 공모하였다.
