A. On December 17, 2012, the Defendant purchased part of 33,770 square meters of I forest land in Busan-gun, Busan-gun (hereinafter “the forest land before the instant partition”) from H to a corporation established for the purpose of real estate sale and lease business, etc.

Before the instant partition, forest land was divided on June 10, 2013, and 6,600 square meters in X, 6,600 square meters in proportion to Y, and 6,600 square meters in proportion to J, 7,370 square meters in proportion to Z. Accordingly, the area of the I land was reduced to 6,600 square meters in proportion to 6,600 square meters.

(B) The Defendant completed the registration of ownership transfer on July 17, 2013 as to the portion of 6,600/6,00 of the instant land, and 1,650/6,00 of the instant land on November 19, 2013.

On January 28, 2013, the Plaintiff entered into a sales contract with the Defendant to purchase KRW 135,000,000, out of the forest land in the instant case prior to the instant division (Evidence A 15-1). On July 5, 2013, immediately after the said division, the Plaintiff entered into a contract with the Defendant to convert the subject matter of sale into KRW 1,322/6,600, out of the instant land 6,600, the sales price of KRW 185,00,000.

On November 19, 2013, the Defendant completed the registration of ownership transfer with respect to the above co-ownership shares to the Plaintiff.
