A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

【2019 order 5882】

1. On September 8, 2019, around 15:28, the Defendant: (a) invadedd the structure of the victim C Co., Ltd. in Gangseo-gu Seoul Metropolitan Government and MF strata, which was operated by the victim C Co., Ltd.; (b) obstructed the entrance of the customer from entering the said store due to a holiday; and (c) went into the said store and intruded the building managed by the victim.

2. 절도미수 피고인은 2019. 9. 8. 15:30경 제1항과 같은 장소에서, 피해자가 소유한 98,000원 상당의 아뮬렛 운동화가 든 상자를 피고인의 가방 안에 넣고 가 절취하려고 하였으나, 위 마트 보안 관리자에게 발각되는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.

3. Larceny;

A. At around 10:42 of the same day, the Defendant: (a) placed food equivalent to KRW 64,330,00, totaling KRW 64,330, 14,300, as well as KRW 5,530, in the Defendant’s temporary room, on the first floor of “J” operated by the victim I, which is located in Gangseo-gu Seoul Metropolitan Government, in the amount of KRW 29,80,00, which is equivalent to KRW 1 sheet, 5,000, which has been displayed therein; and (b) stolen the Defendant’s bags.

[2019 Highest 6602] On November 30, 2019, the Defendant: (a) around 13:50 on the second underground floor of Gangseo-gu Seoul Metropolitan Government, “D” operated by the victim C Co., Ltd. on the second underground floor of Gangseo-gu Seoul Metropolitan Government; and (b) on the bank of goods equivalent to KRW 26,800, total of which is 26,800, i.e., 13,000.
