The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. misunderstanding of facts and misapprehension of the legal doctrine) The Defendant did not take part in the victim’s block or occupy several times due to the victim’s shock.

2) Although the Defendant was able to take the floor by breaking the victim’s abundance and breaking his head, this constitutes a legitimate defense since the Defendant passive response was made in order to prevent the victim from assaulting the Defendant significantly.

Nevertheless, the judgment of the court below which convicted the Defendant of the facts charged of this case is erroneous in the misapprehension of facts and legal principles.

B. The sentence of the lower court’s improper sentencing (4 months of imprisonment) is too unreasonable.

2. In full view of the following circumstances revealed by the evidence duly adopted and investigated by the court below regarding the assertion of misunderstanding of facts and legal principles, the defendant can be admitted that he/she supported several times by scambling the victim, and the defendant's act of scambling the victim's appearance beyond the victim's appearance and taking the head on the floor by scambling the victim's head does not constitute a legitimate defense.

Therefore, the judgment of the court below which found the defendant guilty of the facts charged of this case is just, and there is no error of law by misunderstanding facts or misunderstanding of legal principles
