The appeal is dismissed.

The grounds of appeal are examined.

In light of the relevant legal principles and records, although the reasoning of the court below is inappropriate, the conclusion that the plaintiff's claim for damages is not accepted is eventually justified.

In so doing, contrary to what is alleged in the grounds of appeal, the court did not err by misapprehending the legal principles as to absolute effect between the vicarious debtors jointly and severally liable, the subjective scope and interpretation of declaration of intent, the subject and effect of compromise in litigation

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
