A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

2. 공무집행방해 피고인은 2015. 7. 26. 00:20경 제1항의 이유로 현행범인으로 체포되어 인천 남동구 F 소재 인천남동경찰서 C지구대에 인치된 상황에서, 화장실을 사용하겠다고 하여 위 지구대 소속 순경 G이 보내주자 화장실 바닥에 놓여있던 마포걸레를 들고 “죽고 싶냐.”라고 큰소리치며 G을 향해 휘두르고, 계속해서 같은 날 01:30경 위 지구대에서 인천남동경찰서로 제43호 순찰차를 타고 이동하던 중 인천 남동구 구월동 소재 전재울사거리에 이르러 G에게 “짭쌔 새끼들, 경찰관 너희들 다 목을 따버린다.”라고 욕설을 하고 양손으로 G의 양쪽 관자놀이 부위를 각 1회씩 때렸다.
