A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 14, 2014, the Defendant received a summary order of KRW 3 million from the Jeonju District Court to a fine for a violation of the Road Traffic Act; and on December 11, 2015, the same court issued a summary order of KRW 5 million as a fine for the same crime.

On August 26, 2019, at around 22:00, the Defendant operated a three-dimensional car in the vicinity of the branch in Kim Jong-si Kim Jong-si, with drinking alcohol, and arrived at the front of the 134 general social welfare center in the area of the father-gun, Seoan-gun.

피고인은 그 무렵부터 위 승용차 안에서 시동을 켠 채 잠을 자다가, 2019. 8. 27. 00:30경 위 승용차가 길 한가운데 서있다는 신고를 받고 현장에 출동한 부안경찰서 소속 경위 D으로부터 피고인이 정상적인 발음으로 말을 하지 못하고, 비틀거리며 걷는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 약 16분간 3회에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았으나, ‘내가 아는 사람이 많다. 술을 많이 먹지도 않았다. 그냥 봐주면 안되냐’고 말하고, 음주측정기에 입김을 불어 넣는 시늉만 하는 방법으로 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.

As above, the Defendant refused to take a drunk test and thereby violated the regulations on the prohibition of drunk driving at least twice.
