1. Basic facts

A. The Plaintiff is a building owner who requested the Defendant to construct a new D neighborhood living facility on C’s ground (hereinafter “instant building”) at both weeks, and the Defendant is a building contractor who received a contract from the Plaintiff for the said construction.

B. The Plaintiff entered into a construction contract with the Defendant (hereinafter “instant construction contract”), and paid each of the following KRW 29,00,000,000, in the name of the construction cost, to the Defendant on October 16, 2018, and KRW 99,00,000,000, respectively, on November 13, 10 of the same year.

C. The instant construction project did not proceed as scheduled due to the delay in storage of materials, etc., and was conducted on December 31, 2018, which was about 20 days before the deadline for construction, on December 12, 2018.

(A) The Plaintiff notified the Defendant of the termination of the instant construction contract on the 20th of the same month.

On December 21, 2018, E of the Defendant’s former representative director drafted at the F Office, at the F Office, a letter of waiver of construction work (Evidence A 3; hereinafter “instant letter of waiver of construction work”).

On this construction project, the Defendant waives the construction project on December 20, 2018, as it is inevitable to proceed with the construction project under mutual agreement with the Plaintiff (D) regarding the contract for the construction project.

Provided, That two structures of the stairs room, tax invoices shall be issued until December 24, 12, and documents necessary at the time of completion shall be issued later only until the process of the present process.

I draw up this document by mutual agreement that the payment will take effect until December 24, 2018 with respect to the remaining work price of KRW 58,500,000,000 (including KRW 357,50,000,000) which has been mutually agreed upon among the total work price of KRW 357,50,000,000,000 (including value-added tax).

E. The Plaintiff is with G Co., Ltd. on December 24, 2018.
