A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On January 9, 2013, the Defendant was sentenced to a fine of KRW 3 million for a violation of the Road Traffic Act (driving) in the Suwon District Court’s Pyeongtaek site on January 9, 2013, and a fine of KRW 4 million for the same crime at the Incheon District Court on February 28, 2014, respectively.
1. 도로교통법위반(음주측정거부) 피고인은 2014. 4. 17. 20:50경 이천시 백사면 도지리에 있는 ‘도지초등학교’ 앞 부근에서, B 그랜드 카니발 승용차의 운전석에 앉은 상태에서 도로 가운데 시동을 켠 채 위 차량을 정차하고 있는 모습이 순찰 중이던 이천경찰서 C파출소 소속 경위 D 등에게 발견이 되었는바, 당시 피고인에게 술 냄새가 나고 얼굴에 홍조를 띠는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 사유가 있어 위 C파출소까지 임의동행된 다음 경찰관으로부터 같은 날 22:05경부터 같은 날 22:31경까지 3회에 걸쳐 호흡측정 방식에 의한 음주측정을 요구받았으나 이에 응하지 아니하였다.
2. On April 17, 2014, the Defendant violated the Road Traffic Act (unlicensed Driving) without obtaining a driver’s license on a motor vehicle on or around 20:50, and driving a motor vehicle in Grandland within the 1km section from the front day of the “former Stock Party” located in the Mag-si Mag-si to the front day of the “Dok Elementary School” located in the same Dog-ri.

1. Of concurrent crimes, the former part of Article 37, Article 38 (1) 2, and Article 50 of the Criminal Act (within the scope of adding up the long-term punishments for the crimes of the two crimes);
1. Articles 53 and 55(1) of the Criminal Act for discretionary mitigation;
