1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

Basic Facts

The following facts shall not be disputed between the parties, or may be recognized by comprehensively considering the purpose of the entire pleadings in each entry in Gap evidence of subparagraphs 1 through 9 and Eul evidence of subparagraphs 1 through 5 (including each number, if any).

In order to promote the housing reconstruction project of Seocho-gu Seoul Metropolitan Government I (hereinafter “instant reconstruction project”), the defendant is a housing reconstruction project association that obtained authorization from the head of Seocho-gu on May 10, 2012 from the head of Seocho-gu pursuant to the former Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (amended by Act No. 11580, Dec. 18, 2012; hereinafter “former Act”), and completed the registration of incorporation on May 14, 2012.

On August 2017, the Plaintiffs acquired each real estate listed in the separate sheet (hereinafter “each of the instant real estate”) in the instant reconstruction project zone.

The defendant's claim for sale of real estate stated in [Attachment 1] and 2 of the defendant's list of the defendant's claim for sale is the lawsuit claiming sale of the above real estate in accordance with Article 39 of the former Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions, etc. (hereinafter "the lawsuit claiming sale of the above real estate"), and the sales contract entered into according to the defendant's claim for sale is "the first sales contract of this case".

The above court filed a claim against D on November 6, 2015, and accepted the defendant's claim against D.

The Seoul High Court appealed as 2015Na2072055 against the above judgment, but the above court dismissed D's appeal on January 13, 2017, and thereafter the above judgment became final and conclusive.

The defendant's claim for sale of real estate stated in the attached list 3 and 4 of the defendant is the Seoul Central District Court 2012Gahap92819, which is "K land and housing" as stated in the attached list 3 and 4 of the attached list.
