A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On October 24, 2019, the Defendant was sentenced to six months of imprisonment with prison labor at the Seoul Northern District Court for the crime of interference with business and completed the execution of the sentence at the Seoul Eastern Detention Center on January 25, 2020.

1. Fraud;

A. On January 27, 2020, the Defendant: (a) entered a restaurant operated by the victim C in Gwangjin-gu Seoul Special Metropolitan City on January 27, 2020; (b) was committed as if he would normally pay the price despite the absence of the intent or ability to pay the price; and (c) received food equivalent to KRW 33,000,000, such as a small liquor of KRW 28,000, a sum of KRW 5,000.

B. At around 07:30 on January 28, 2020, the Defendant committed as if he had no intent or ability to pay the price by entering a restaurant operated by the victim E in Gwangjin-gu Seoul Special Metropolitan City, even though he did not have the intent or ability to pay the price, he received food equivalent to KRW 16,00,00 in total, including 1,6,00, 1, 2, 2, and 2, 200.

2. On January 28, 2020, the Defendant interfered with business: (a) around 07:50, around 1-b.

항 기재 장소에서 술에 취해 욕설을 하고 소리를 지르며 피해자 E에게 “사장 이리 와봐”라고 소란을 피우고, 이에 피해자로부터 계산을 요구받자 피해자에게 “이새끼가 니가 사장이야 내가 뭘 잘못했어”라고 말하며 욕설을 하고, 계속하여 피해자가 피고인을 경찰에 신고하자 자신이 앉아있던 테이블 위 그릇들을 양팔로 쓸어내려 깨뜨리고 “죽여버린다”라고 말하며 피해자에게 달려드는 등 소란을 피워 식당 내 손님들의 식사를 방해하고 식당 밖의 손님들이 음식점에 들어오지 못하게 하여 약 30분 가량 위력으로써 피해자의 식당 운영업무를 방해하였다.
