[Defendant A] The defendant shall be punished by imprisonment for ten months.

However, for two years from the date this judgment becomes final and conclusive, the above sentence shall be executed.

Punishment of the crime

1. On May 2020, Defendant A received a proposal from an employee of the singishing operations (hereinafter “C”) in order to deposit without passbook in the account under the direction of the singishing organization, when a member of the said organization misrepresents himself/herself as a D bank, staff of the Financial Supervisory Service, etc., and deceivings the victims to prepare and deliver cash, Defendant A conspired to deposit without passbook in the order of deposit to the account under the direction of the singishing organization.

On May 7, 2020, the victim E calls from the victim E at a non-place on the victim’s name, and misrepresents the victim E with the victim’s staff, and makes a false statement to the effect that “The F card used as the F card is possible to issue the marina passbook because it has no means to lend, and it is possible to promptly repay the card loan after receiving the card loan.” On May 15, 2020, the victim calls the victim at a non-place on the victim’s account and calls the victim for a “on the face of KRW 6 million who will send the D bank staff to handle the transfer from the D bank,” and then, the victim prepared the cash.

At around 14:30 on May 15, 2020, the Defendant: (a) delivered a place to collect money through a telegram from an employee operating a telegram from his name scaming in accordance with the above public offering; (b) received the victim as if he was “D Bank I” and received 600,000 won in cash from the victim; and (c) transferred the remainder of the money excluding KRW 500,000 to a nearby J bank and transferred the money to the account designated by the scaming Organization.

Accordingly, the defendant, in collusion with the staff of singinging, deceivings the victim and deceivings the victim.
