A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant posted a letter at a place where it is difficult to know the place around August 30, 2019, stating that “The sales of O Game P” on the O’s Internet game website without an intention or ability to send money even if he/she receives money, and then fraudulently received 3.60,00 won from the victim Q Q Q, who reported it and received 28 times a transfer of money from the victim’s R Bank S Bank’s virtual account (T) from July 16, 2019 to September 8, 2019, and received 4,431,200 won in total from the victims over 28 times.

Around September 1, 2019, the Defendant, “2019No6742,” made a false statement to the effect that “I will sell KRW 232,000,000 of the game money” in “U, an online game, in spite of no intent or ability to send a game money,” at a place where the location cannot be known, even if having received money, and then, he/she received KRW 232,00 from the victim V to the instant bank S Bank (T) account in the name of the Defendant.

Around August 24, 2019, the Defendant posted a false statement stating that “a galtho S8 mobile phone is sold” with access to the Internet “W” website, and that “a galthothoopic mobile phone is sold,” and that “a galthoopic mobile phone is sent to the victim C who contacted the deposit of money, on a galthothal basis.”

However, in fact, the Defendant did not have the above goods, and received money from the victim as if they were sold, and then thought that they were used as money for gambling, etc., so there was no intention or ability to send the said goods even if he received money from the victim.

The defendant deceivings the victim as above and receives 120,000 won from a Y bank account in the name of X designated by the defendant as the price for goods on the same day.
