Defendant B, C, and E (Name B: F) as to 1,250 shares of each of the shares listed in the separate sheet.
Reasons
1. Basic facts
A. The Plaintiff and E (the name before the opening of the name: F; hereinafter “E”) were legally married couples. The Plaintiff filed a lawsuit of divorce against E on April 15, 2013, and on February 18, 2014, the Daejeon Family Court Branch Decision 2013DMa976, “Plaintiff and E is divorced,” and E pays to the Plaintiff KRW 20 million as consolation money, and E pays to the Plaintiff for compensation for delay, and E transfers shares of H 636 shares and KRW 1500 shares of D with division of property, and notifies the Plaintiff that H and D transferred each of the above shares (hereinafter “instant divorce judgment”), and the said judgment became final and conclusive at that time (hereinafter “instant divorce judgment”).
B. In the instant divorce lawsuit, although the aforementioned court stated that E, among the total outstanding shares of 5,00 shares, was holding 2,500 shares E, 1,250 shares, 1,250 shares, and 1,250 shares each among the total outstanding shares of 5,00 shares, the aforementioned court held that E, while holding all the above shares, actually transferred 1,250 shares to I under its name as a repayment of the obligation to I on June 2013, E, and E, under actual transfer of 12,50 shares for 50 million won as a repayment of the obligation to G, but it refused to return the above shares on September 2013 due to the repayment of 5,000 shares, and that E and G shares are both owned by E and D as property division.
C. Meanwhile, on December 30, 2013, E transferred 1,250 shares of Defendant D to Defendant B and C, and each of 75 shares of G was transferred to Defendant B and C on the ground of transfer from December 30, 2013, and the remainder of 1,100 shares was transferred to Defendant B and C on the ground of transfer from January 28, 2014.
As of March 19, 2014, as of March 19, 2014, Defendant D’s register of shareholders is 1,250 shares by I, and Defendant C’s Republic of Korea 1.
