1. The Defendant (Counterclaim Plaintiff) against the Plaintiff (Counterclaim Defendant)

Basic Facts
A. On October 20, 1990, the Plaintiff purchased the CJ 215 square meters (hereinafter “instant land”) and the housing on the same day, and completed the registration of ownership transfer in the name of each Plaintiff on October 29, 190 with respect to the instant land on the same day.
B. On July 12, 1985, the Defendant purchased the pertinent land D, Chungcheongnam-gun, 195 square meters (hereinafter “instant land”) and its ground, adjacent to the same side of the instant land No. 1, and completed the registration of ownership transfer under the Defendant’s name on July 15, 1985.
C. At present, the fence was constructed in line between the land No. 1 and the land No. 2 of this case according to the line connecting each point in the order of indication of the annexed drawing No. 2, 1, 12, 11, 10, 9, 8, 7, and 6. Among them, the wall on the line connecting each point in the order of indication No. 6, 7, 8, and 9 of the annexed drawing No. 6, 7, 8, and 9 are those constructed by the Defendant around April 2003.
