피고인은 2014. 1. 21. 23:32경 서울 중구 남대문시장4길 46호 지하철 4호선 충무로역에서 회현역으로 운행중인 4223호 전동차 안에서 맞은편 좌석에 다리를 꼰 채로 회색 짧은 치마와 검정색 스타킹을 입고 앉아 있던 성명불상의 피해자를 상대로 셔터소리가 나지 않는 ‘좋은카메라’ 어플로 피고인의 휴대전화 카메라를 작동하여 피해자의 허벅지 및 다리부위를 몰래 촬영하였다.
