1. An appeal by the Plaintiff (Counterclaim Defendant) against the principal lawsuit and the counterclaim by the Defendant (Counterclaim Plaintiff).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. The Plaintiff, Defendant, C, and D are E on September 1, 1983 (hereinafter “E”).
(2) The Plaintiff, the Defendant, and C agree to jointly manage the automobile maintenance project in their trade name, and the shares of D are equally divided. Around January 1986, D withdraws from the partnership business and the remaining three partners agreed to pay D liquidation money following the withdrawal from the partnership business to D, and the Plaintiff, the Defendant, and C shall have one-third shares, respectively. (2) The three partners, including the Plaintiff, etc., purchased the FF large 189 square meters in their trade name in Daegu-gu, Daegu-gu, 1986, and concluded a sales contract in their name and completed the registration of transfer of ownership.
3) After C’s death in around 1988, G, H, I, J, K, and L succeeded to the partnership business shares of C, and maintained the partnership relationship with the Plaintiff and the Defendant. B. The partners including the Plaintiff, etc. terminated the partnership business agreement on March 23, 2006. Of the real estate that is the remainder of the partnership business at the time of termination of the partnership business agreement, the Defendant filed an application for the transfer registration of 1/28 shares, G, H, H, H, and I owned 2/28 shares, respectively. The Plaintiff filed an application for the transfer registration of 1,018 square meters of land with the Plaintiff solely owned 2/3 shares, and the Plaintiff owned 1,018 square meters of land and 1,000 square meters of land, and 1,018 square meters of land and 1,000 square meters of land and 1,000 square meters of land and 2/198 square meters of land, respectively, and the Plaintiff filed an application for the transfer registration of 198/3 square meters of land.
